Terms and Conditions

Isivuno Auctioneers Afrika retains full authority to control, regulate, and manage the auction process. All auctions are recorded, and such recordings are not accessible to the public or the Purchaser unless required by a court order or law. The recordings serve as prima facie (rebuttable) proof of the auction proceedings.

Each item is sold as an individual lot unless grouped as a parcel of assets ("lots"). Isivuno may withdraw any item or lot from the auction without penalty or prior notice, provided the Seller permits such withdrawal in writing. Goods are sold as a lot or parcel, subject to these terms and conditions.

The highest accepted bidder for any goods is deemed the Purchaser. In case of a dispute regarding the highest bidder, Isivuno may re-auction the goods. All bids exclude VAT and buyer’s premium, which are payable in addition to the bid amount.

These terms and conditions, along with any special conditions for the auction or specific goods, will be announced before the auction begins. The Purchaser is bound by all announced terms and conditions.

Upon the fall of the hammer, the sale is final and irrevocable, subject to any applicable suspensive conditions. Risk in the goods transfers to the Purchaser immediately upon the fall of the hammer, regardless of physical possession.

The Purchaser acknowledges inspecting the goods and accepts them in their disclosed condition, as per the condition/inspection report provided. Isivuno and the Seller make no warranties or guarantees beyond the condition report, and Isivuno is not liable for undisclosed conditions or errors in description.

The Purchaser must pay the full purchase price, including VAT and buyer’s premium, to receive a paid invoice. Delivery is not permitted until payment is confirmed and, for motor vehicles or items requiring documentation, until all relevant documents are completed and delivered to Isivuno. The Purchaser is responsible for all delivery costs.

Delivery is deemed complete upon issuance of the paid invoice or delivery of identifiable elements (e.g., keys). The Purchaser must remove goods from Isivuno’s premises within the announced period. Non-delivery due to incomplete documentation does not entitle the Purchaser to cancel the sale.

After the fall of the hammer, the Purchaser bears all risks for the goods, including shortages or damage, even if stored at Isivuno’s premises. Storage fees, as announced or displayed at the auction venue, apply if goods remain on premises.

If the Purchaser fails to pay the full purchase price, remove goods, or comply with these terms, all payments (fees, buyer’s premium, deposits) are forfeited to Isivuno or the Seller as pre-estimated damages. Isivuno may cancel the sale if required documents are not provided within 21 days, and the Purchaser must seek damages from the Seller.

Isivuno may re-auction goods without notice if the Purchaser fails to comply. If the re-auction yields less than the original sale price (after deducting costs), the Purchaser must pay the difference as liquidated damages. Isivuno is not liable for losses due to Seller-related issues or sale termination.

No variations to these terms are valid unless in writing and signed by the Purchaser and Isivuno. Indulgences granted do not waive Isivuno’s or the Seller’s rights. The Purchaser acknowledges that motor vehicle details (e.g., year, registration, odometer) were displayed at the auction. The Purchaser’s registered address is their domicilium citandi et executandi. The Purchaser consents to Magistrate’s Court jurisdiction, though Isivuno or the Seller may opt for High Court proceedings. Legal costs are payable on the attorney-client scale. The Purchaser cedes movable and immovable property to Isivuno to satisfy debts, which are specially executable. Terms are severable, and the buyer’s premium is payable on the auction date as announced.
